Welcome to Snow Star Ripening. These Terms and Conditions (“Terms”) govern your use of our website located at https://snowstarripening.com/ (“Website”) and the purchase of our fruit ripening products (“Products”). By accessing or using our Website, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Website.

Definitions

• We”, “us”, “our”: Refers to Snow Star Ripening.
• “You”, “your”: Refers to the user or customer using our Website.
• “Website”: Refers to our website located at https://snowstarripening.com/.

Formation of contract

• Your order is an offer to buy. Snow Star Ripening may send an order confirmation email to acknowledge receipt of your order, but Snow Star Ripening does not accept your order until we send you notice that the Product has shipped. Snow Star Ripening reserves the right at any time, even after we send you a confirmation email, to decline or cancel your order or to limit order quantities for any reason, including errors or suspected fraud.
• The Products sold and/or services rendered are subject to these Terms to the exclusion of any other terms and conditions stipulated or referred to by the Customer. The Customer acknowledges that they are aware of the contents of and agree to be bound by these Terms and Conditions. Neither Snow Star Ripening’s acknowledgment of a purchase order nor its failure to object to conflicting, different, or additional terms and conditions in a purchase order shall be deemed an acceptance of such terms and conditions or a waiver of the provisions hereof.

Orders, Price and Payment 

• Unless credit terms have been expressly agreed by Snow Star Ripening, payment for the Products or services, including applicable taxes, shall be made in full before physical delivery of Products or services, or a partial advance payment for transportation charges with the balance due on delivery (COD Mode).
• Customers shall bear all country, provincial, municipal, government, state, and local sales, use, goods and services, value-added, excise, privilege, and similar levies/taxes.
• Time for payment is of the essence. Snow Star Ripening reserves the right to charge interest at the rate of 2% per month from the date on which the payment was due until the date of actual receipt of payment.
• Prices and promotions are subject to change. Snow Star Ripening strives to communicate accurate pricing and product information, but errors may occur. In the unlikely event that an error impacts your order, or a Product ordered is no longer available, we will either contact you for instructions or cancel your order.

Delivery

• Snow Star Ripening shall deliver the Products with our delivery partner to the place of delivery designated by the Customer and agreed to by Snow Star Ripening within a minimum of 3 working days and a maximum of 10 working days after the order is received and after telephonic confirmation by the Customer.
• You are responsible for inspecting the package(s) upon delivery and must note any visible damage on the proof of delivery (POD) or other delivery receipt the carrier asks you to sign. Snow Star Ripening is not responsible for any visible shipping damages not noted on the delivery receipt.
• Any dates quoted by Snow Star Ripening for the delivery of the Products are approximate only and shall not form part of the contract. Snow Star Ripening shall not be liable for any delay in the delivery of the Products and/or services, howsoever caused.
• Snow Star Ripening may revise and/or discontinue products at any time without notice as part of our policy of ongoing product updates and revisions. Revised or updated products will have the functionality and performance of the Products ordered. The Customer accepts that our policy may result in differences between the specification of products delivered and the specification of Products ordered. There may be occasions when Snow Star Ripening confirms orders but learns that it cannot supply the ordered Products, either at all or in the quantities ordered, such as when the products are no longer being manufactured, become unavailable to Snow Star Ripening, or when there is a pricing error. In such circumstances, Snow Star Ripening will contact the Customer to inform them about alternative products that might meet their needs. If the Customer does not wish to order alternative products, Snow Star Ripening will cancel the order for Products that cannot be supplied and will refund the purchase price for those products.
• For systems or products purchased outside India, support and services will be provided only on a best-effort basis, and such products shall not be entitled to any replacement or refund.
• In the case of orders from outside India, prices and delivery charges will change depending on the circumstances and place of delivery.

Acceptance of Products

• Unless the Customer notifies Snow Star Ripening to the contrary on the day of delivery and such notification is confirmed in writing within two days, the Products shall be deemed to have been accepted by the Customer as being in good condition and in accordance with the Contract. The Customer shall not be entitled to withhold payment of all or any part of the price of the Products while any claim is being investigated by Snow Star Ripening.
• If you are an end-user customer and wish to exchange a product that you have directly purchased from Snow Star Ripening in India due to a technical issue, the product must be returned within 30 calendar days from the date of delivery. Unfortunately, we cannot accept refund requests once the product is delivered. Please note that the right to cancel or exchange only applies to home customers buying directly from Snow Star Ripening at https://snowstarripening.com/.
• If you wish to cancel your order, you must do so before delivery. If you have made a prepaid payment, we will refund the amount after deducting transportation charges. If you have chosen COD, we may charge transportation fees in advance, which will not be refunded. The cancellation will be applicable as per the cancellation procedure outlined by Snow Star Ripening.
• Exceptions to the 30-day period include situations where the product has an issue confirmed by our customer support team that cannot be resolved without a replacement. In such cases, the product will be eligible for exchange or replacement by Snow Star Ripening.

Service and Technical Support

• Snow Star Ripening will provide general service and technical support to Customers in accordance with the current service and technical support policies in effect. Service and support offerings may vary from product to product. If the Customer purchases optional services and support as listed on Snow Star Ripening’s invoice, Snow Star Ripening will provide the optional service and support to the Customer in accordance with the then-current terms and conditions in the optional service contract between Snow Star Ripening and the Customer (available via the Internet on Snow Star Ripening’s website at https://snowstarripening.com/ or upon request) in addition to the Standard Warranty or Relevant Warranty. Snow Star Ripening may, at its discretion, revise its general and optional service and support programs and the terms and conditions that govern them. Snow Star Ripening has no obligation to provide service or support until Snow Star Ripening has received full payment for the Product or service/support contract for which service or support is requested.

Liability

• In no event shall Snow Star Ripening be liable for any indirect, consequential, exemplary, incidental, or punitive damages, including lost profits, arising out of or in connection with the use or inability to use our products, even if Snow Star Ripening has been advised of the possibility of such damages. By using our products, you agree that Snow Star Ripening’s liability in any dispute shall be limited to the total amount you paid for the order or product at issue.
• Snow Star Ripening will provide support services for products beyond their warranty period, subject to the availability of products and spare parts in our inventory. If certain products or spare parts are no longer available due to technological advancements or other reasons, Snow Star Ripening may, at its discretion, offer the customer an upgraded or refurbished product. The cost of such upgraded or refurbished products will vary and must be borne by the customer.
• Snow Star Ripening shall not be liable in contract or in tort for any loss or damage suffered beyond what is outlined in these Terms and Conditions and under applicable statute.
• To the extent permitted by law, Snow Star Ripening’s total liability for each event or series of connected events shall not exceed the invoiced amount for the applicable products and/or services under the contract.
• Snow Star Ripening and the customer agree that Snow Star Ripening shall not be liable for products not being available for use. Any service response times provided are approximate only. Snow Star Ripening shall not be liable for any incidental, indirect, special, or consequential damages arising out of or in connection with the purchase, use, or performance of products or services.
• To the extent permitted by law, Snow Star Ripening reserves the right to correct any typographical, clerical, or other errors or omissions in sales literature, quotations, price lists, acceptances of offers, invoices, or other documents without liability.

Force Majeure

Neither party shall be held liable for any delay in performing its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of the delaying party. In such cases, the affected party shall be entitled to a reasonable extension of time to fulfill its obligations.

Export Compliance

Both parties agree to comply with all applicable laws, orders, and regulations of any governmental authority regarding their activities related to these Terms and Conditions and any contracts formed under them. Snow Star Ripening and the customer acknowledge that products sold under any contract may be subject to export control laws and regulations. The products may not be sold, leased, or transferred to restricted end-users or countries, nor may they be utilized for activities related to weapons of mass destruction. Each party agrees to indemnify and hold the other harmless from any claims arising from violations of applicable export laws.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, and any disputes shall be subject to the jurisdiction of the courts in Hisar, Haryana, India.

Amendment of Terms and Conditions

Snow Star Ripening reserves the right to modify these Terms and Conditions at any time without prior notice. It is the responsibility of the customer to review the terms periodically for any changes.

Website Information

Information provided on the Snow Star Ripening website regarding its products may not always be up to date, and Snow Star Ripening makes no commitment to update such information.

Website Operation

Snow Star Ripening reserves the right to modify, suspend, or terminate operation of its website or any part thereof without prior notice. This includes the right to modify or change the website’s content and to interrupt operation for maintenance or other changes.
